U okviru projekta „Budući profesionalci za transparentnije javne nabavke – TRANSPIRE“, Centar za sigurnosne studije (CSS) je, 28. decembra 2022. godine, održao seminar „Uvod u javne nabavke u BiH i rizici od korupcije“ u Sarajevu. Radi se o prvom od tri seminara namijenjenih za studentsku populaciju u BiH s ciljem približavanja sistema funkcionisanja javnih nabavki te upoznavanja sa koruptivnim rizicima u ovoj oblasti. Prvi seminar u Sarajevu okupio je 25 studenata sa Fakulteta za kriminalistiku, kriminologiju i sigurnosne studije Univerziteta u Sarajevu.

U uvodnom dijelu seminara studentima su se obratili generalni sekretar CSS, gospodin Benjamin Plevljak, direktor Ureda za odnose s javnošću u Ambasadi SAD, gospodin Robert Mearkle, koji je u svom govoru izrazio zadovoljstvo zbog partnerstva Ambasade SAD-a i CSS u ovom projektu i istaknuo napore koje Ambasada SAD ulaže u unapređenje sistema javnih nabavki u BiH, te profesor na Fakultetu za kriminalistiku, kriminologiju i sigurnosne studije, gospodin Armin Kržalić. Seminar je svojim prisustvom uveličao i direktor Agencije za javne nabavke BiH, gospodin Tarik Rahić, koji je u svom obraćanju istakao da je sistem javnih nabavki u BiH potrebno stalno unapređivati u dijelu borbe protiv korupcije. Istakao je da ovakvi vidovi projekata imaju neprocjenjivu ulogu i pozvao je sve univerzitete u BiH da iskoriste ovaj projekat te da hitno razmotre da u svoje osnovne studijske programe, na odgovarajućim fakultetima, obavezno uvrste i predmete koji bi izučavali javne nabavke.

U okviru prve sesije, gospodin Sanjin Hamidičević, upoznao je studente sa javnim nabavkama u BiH. U uvodnom dijelu svog izlaganja objasnio je šta su javne nabavke, njihovu ulogu u ukupnom funkcionisanju državnog aparata, vrste postupaka koje postoje u Zakonu o javnim nabavkama BiH, kada je počela primjena Zakona o javnim nabavkama u BiH, itd. Gospodin Hamidičević, upotrebom različitih primjera, studentima je objasnio složenu materiju javnih nabavki na vrlo zanimljiv način. Također, u okviru prve sesije, gospodin profesor Armin Kržalić upoznao je studente sa specifičnostima javnih nabavki u sektoru sigurnosti.

U drugoj sesiji, o koruptivnim rizicima u javnim nabavkama, studentima je predavanje održao gospodin Emsad Dizdarević, program menadžer u Transparency International BiH. Gospodin Dizdarević je u uvodnom dijelu svog izlaganja studentima temeljito objasnio sve činjenice zbog kojih pojedini ugovorni organi pribjegavaju primjeni nekih postupaka koji su manje transparentni, odnosno koji indikativno ukazuju na koruptivne radnje. U drugom dijelu sesije, gospodin Dizdarević je studentima približio načine na osnovu kojih ugovorni organi vrše korupciju u javnim nabavkama pa je tako istakao, između ostalog, problem lošeg planiranja nabavke, cijepanja vrijednosti nabavke (kako bi se na taj način zaobišli transparentniji postupci nabavke), preciziranje tehničke specifikacije javne nabavke koja odgovara samo jednom ponuđaču i sl.

Kako bi se procijenio nivo usvojenog znanja studenata, sačinjeni su ulazni i izlazni testovi od predavača. Podaci pokazuju da su studenti u prosjeku tačno odgovorili na 60% pitanja ulaznog testa, dok su, po završetku seminara, u prosjeku tačno odgovorili na 90% pitanja izlaznog testa. Također, seminar je opisan kao veoma koristan od studenata, a na osnovu procjene znanja na ulaznim i izlaznim testovima evidentno je da su usvojili predočena znanja.

Projekat „Budući profesionalci za transparentnije javne nabavke – TRANSPIRE“ se finansira grantom Ministarstva vanjskih poslova Sjedinjenih Američkih Država kroz Program malih grantova Demokratske komisije. Projekat je započeo u augustu 2022. godine, a predviđeno vrijeme trajanja je 10 mjeseci.

First seminar within the project “TRANSPIRE” was held

As part of the project “Future Professionals for More Transparent Public Procurement – TRANSPIRE“, the Centre for Security Studies (CSS), in Sarajevo on December 28, 2022,  held a seminar “Introduction to Public Procurement in BiH and Risks of Corruption“. It is the first of three seminars intended for the student population in BiH with the aim of introducing them to the system of public procurement, as well as familiarizing them with corruption risks in this area. The first seminar in Sarajevo gathered 25 students from the Faculty of Criminalistics, Criminology and Security Studies of the University of Sarajevo.

In the introductory part of the seminar, the students were addressed by the Secretary General of the CSS, Mr. Benjamin Plevljak, the Head of the Public Diplomacy Section of the US Embassy in BiH Mr. Robert Mearkle who expressed his satisfaction with the partnership between the US Embassy and the CSS in this project and highlighted the efforts that the US Embassy invests in improving the public procurement system in BiH, and Mr. Armin Krzalic, professor at the Faculty of Criminalistics, Criminology and Security Studies. The director of the BiH Public Procurement Agency, Mr. Tarik Rahic also attended the seminar and pointed out that the public procurement system in BiH must be constantly improved in the area of the fight against corruption. He pointed out that these types of projects have an invaluable role and called all universities in BiH to take advantage of this project and to urgently consider including subjects that would study public procurement in their basic study programs.

During the first session, Mr. Sanjin Hamidicevic introduced the students to public procurement in BiH. In the introductory part of his presentation, he explained what public procurement is, its role in the overall functioning of the state apparatus, the types of procedures that exist in the Law on Public Procurement in BiH, when the implementation of the Law on Public Procurement in BiH began, etc. Mr. Hamidicevic, using various interesting examples, explained the complex matter of public procurement. Also, within the first session, Professor Armin Krzalic introduced the students to the specifics of public procurement in the security sector.

In the second session, Mr. Emsad Dizdarevic, Program Manager at Transparency International BiH, gave a lecture to the students about corruption risks in public procurement. In the introductory part of his presentation, Mr. Dizdarevic thoroughly explained to the students all the facts due to which certain contracting authorities resort to the application of some procedures that are less transparent, i.e. that indicate corrupt acts. In the second part of the session, Mr. Dizdarevic introduced the students to the ways on the basis of which contracting authorities commit corruption in public procurements, thus highlighting, among other things, the problem of poor planning of procurement, splitting the value of the procurement (in order to bypass more transparent procurement procedures), specifying the technical specification of public procurement that corresponds to only one bidder, etc.

In order to assess the level of acquired knowledge of the participants, entry and exit tests were created. The data show that, on average, students correctly answered 60% of the entry test questions, while, after the seminar, they answered correctly on average 90% of the exit test questions. Also, the seminar was described as very useful by the students, and based on the assessment of knowledge on the entry and exit tests, it is evident that they have adopted the presented knowledge.

The project “Future professionals for more transparent public procurement – TRANSPIRE” is funded by the United States Department of State through the Democracy Commission Small Grants Program. The project started in August 2022, and the expected duration is 10 months.
