U okviru projekta „Budući profesionalci za transparentnije javne nabavke – TRANSPIRE“, Centar za sigurnosne studije (CSS) je 15. novembra održao trening „Javne nabavke u BiH i rizici od korupcije“ u Banjoj Luci za studente s različitih fakulteta u Bosni i Hercegovini (BiH). Suština treninga bila je njihovo uvođenje u sistem javnih nabavki u BiH te upoznavanje sa koruptivnim rizicima u ovoj oblasti. Inače, ti studenti će biti, zajedno s još dva istraživačka novinara, članovi radnih grupa koje će sačiniti dva godišnja izvještaja u pogledu transparentnosti i regularnosti javnih nabavki obavljenih u sektoru sigurnosti u 2020. i 2021. godini.
U prvoj sesiji treninga, gospodin Dražen Vidaković (šef Grupe za normativno-pravne poslove Agencije za javne nabavke BiH, Filijala Banja Luka) članove radnih grupa je na temeljit i jezgrovit način uveo u oblast javnih nabavki u BiH. U uvodnom dijelu svog izlaganja, članovima je objasnio šta su to javne nabavke, kakav udio one imaju u cjelokupnom funkcionisanju državnog aparata, početak primjene javnih nabavki u našoj zemlji, kao i direktive EU s kojima treba biti usaglašen sistem javnih nabavki u BiH. U drugom dijelu sesije studenti su imali priliku da usvajaju znanja o Zakonu o javnim nabavkama BiH. Gospodin Vidaković je studentima elaborirao činjenice koje zakon reguliše, odnosno šta su to ugovorni organi, koje vrste postupka poznaje Zakon o javnim nabavkama BiH, ko ima obavezu primjene zakona i sl. U zaključnom razmatranju, gospodin Vidaković se dotakao instituta žalbe, kao redovnog pravnog lijeka i mehanizma pravne zaštite učesnika u postupku javne nabavke. Gospodin Vidaković je studentima objasnio koji ugovorni organ, na koji način, u kojem roku i kome može izjaviti žalbu.
O rizicima od korupcije u javnim nabavkama, članove radnih grupa je u drugoj sesiji upoznao gospodin Emsad Dizdarević, program menadžer u Transparency International BiH. Gospodin Dizdarević je u početnom dijelu svog izlaganja članovima detaljno objasnio vrste postupaka koje postoje u Zakonu o javnim nabavkama BiH, kao i činjenice zbog kojih pojedini ugovorni organi pribjegavaju primjeni nekih postupaka koji su manje transparentni, odnosno koji indikativno ukazuju na koruptivne radnje. U drugom dijelu sesije, gospodin Dizdarević je studentima približio načine na osnovu kojih ugovorni organi vrše korupciju u javnim nabavkama pa je tako istakao, između ostalog, problem lošeg planiranja nabavke, cijepanja vrijednosti nabavke (kako bi se na taj način zaobišli transparentniji postupci nabavke), preciziranje tehničke specifikacije javne nabavke koja odgovara samo jednom ponuđaču i sl. U završnom dijelu izlaganja, gospodin Dizdarević je članove radnih grupa upoznao sa web stranicom pratimotendere.ba, a koja je osmišljena na način da kombinacijom različitih pokazatelja rizičnosti, kroz sve faze provođenja postupka javne nabavke, otkrije eventualna kršenja zakona, netransparentnost postupaka, nabavke sa elementima korupcije, nepotrebne nabavke, itd.
Trening je opisan kao veoma koristan od polaznika/ca, a na osnovu procjene znanja ulaznim i izlaznim testovima evidentno je da su polaznici/e usvojili predočena znanja. Inače, za članove radnih grupa će se održati još jedan trening, u okviru kojeg će biti upoznati o specifičnostima javnih nabavki u sektoru sigurnosti te obučeni o metodologiji za praćenje javnih nabavki u ovom sektoru. Navedena metodologija je razvijena u okviru CSS projekta „Izgradnja integriteta i jačanje anti-korupcijskih praksi u sektoru sigurnosti – ACroSS“. Završetkom i usvajanjem znanja kroz dva treninga, članovi radnih grupa će pristupiti izradi dva godišnja izvještaja o transparentnosti i regularnosti javnih nabavki obavljenih u sektoru sigurnosti u 2020. i 2021. godini.
Projekat „Budući profesionalci za transparentnije javne nabavke – TRANSPIRE“ se finansira grantom Ministarstva vanjskih poslova Sjedinjenih Američkih Država kroz Program malih grantova Demokratske komisije. Projekat je započeo u augustu 2022. godine, a predviđeno vrijeme trajanja je 10 mjeseci.

The first training within the project “TRANSPIRE” was held
As part of the project ” Future Professionals for More Transparent Public Procurement – TRANSPIRE“, on November 15 in Banja Luka the Centre for Security Studies (CSS) held a training on “Public procurement in BiH and risks of corruption” for students from various faculties in Bosnia and Herzegovina (BiH). The essence of the training was the introduction to the system of public procurement in BiH and familiarization with the corruption risks in this area. The attending students, together with two other investigative journalists, will be members of working groups that will prepare two annual reports regarding the transparency and regularity of public procurement made in the security sector in 2020 and 2021.
In the first training session, Mr. Drazen Vidakovic, (Head of the Department for Legal Affairs at Public Procurement, Banja Luka Branch) introduced the members of the working groups to public procurement in BiH. In the introductory part of his presentation, he explained what public procurement is, its role in the overall functioning of the state apparatus, when it started to be applied in BiH, as well as EU directives with which the public procurement system in BiH should be harmonized. In the second part of the session, students had the opportunity to learn about the Law on Public Procurement of BiH. Mr. Vidakovic explained to the students the facts regulated by the law, i.e. what contractual authorities are, what types of procedures are recognized by the Law on Public Procurement of BiH, who must apply the law, etc. In the final consideration, Mr. Vidakovic spoke about the institute of appeal as a traditional legal remedy and mechanism of the legal protection of participants in the public procurement process. Furthermore, Mr. Vidakovic explained to the students which contracting authority, in which way, within which period, and to whom can file a complaint.
In the second session, Mr. Emsad Dizdarevic, program manager at Transparency International BiH, informed the members of the working groups about the risks of corruption in public procurement. In the initial part of his presentation, Mr. Dizdarevic explained in detail the types of procedures that exist in the Law on Public Procurement of BiH and the reasons why some contracting authorities resort to the application of some procedures that are not transparent, i.e., that indicate corrupt acts. In the second part of the session, Mr. Dizdarevic spoke about how contracting authorities commit corruption in public procurement, thus highlighting the problem of poor planning of procurement, splitting the value of the procurement (in order to bypass more transparent procurement procedures), specifying the technical specification of public procurement that corresponds to only one bidder, etc. In the final part of the presentation, Mr. Dizdarevic introduced the members of the working groups to the website pratimotendere.ba, which was designed in a way that, through a combination of different risk indicators, through all phases of the public procurement procedure, detects possible violations of the law, lack of transparency of the procedures, procurement with elements of corruption, unnecessary procurement, etc.
The training was described as very useful by the participant and based on the assessment of knowledge through the entry and exit tests, and it is evident that the participants have adopted the presented knowledge. Furthermore, another training will be held for the members of the working groups, during which they will be informed about the specifics of public procurement in the security sector and trained on the methodology for monitoring public procurement in this sector. The methodology above was developed within the CSS project ” Integrity Building and Strengthening Anti-Corruption Practices in the Security Sector – ACroSS”. Upon completion and acquisition of knowledge through two pieces of training, the members of the working groups will prepare two annual reports on the transparency and regularity of public procurements carried out in the security sector in 2020 and 2021.
The project “Future professionals for more transparent public procurement – TRANSPIRE” is funded by the United States Department of State through the Democracy Commission Small Grants Program. The project started in August 2022, and the expected duration is 10 months.
